Ref: Alan Gluth – Conflict of Interest

Dear Holly,

I am writing to tell you about my experience with Allan Gluth. I hope this information may be useful to you. You might want to share this information with the rest of the racing community. It has been many years since I raced but I will always feel like I am part of the racing community, and that is why I want to share this story with you.

I quit racing just about the time you started, but I did get to meet you and your Dad a couple of times at El Paso Speedway Park back in 2000. I remember you used to drive a PT Cruiser when you would come down from Las Cruces  to El Paso to see the races. One time toward the end of the season in 2000, I got to race you and Paddy Rush in a main event in El Paso. I was the track champ in Super Stock that year and to me Paddy Rush was the biggest racer I had ever had a chance to race. You came in first, Paddy came in second, and I came in third.

The story I am really writing to tell you though, is about when I hired Allan Gluth. After more than 3 years on the case, with less than a week to go before trial, and after spending more than $50,000 in legal fees, Alan Gluth withdrew from my case due to conflict of interest.

This is not a situation where I am “accusing” Alan Gluth of conflict of interest. I am stating a fact. The Official paperwork filed with the court by Alan Gluth himself clearly states that he withdrew due to conflict of interest. Any Lawyer in New Mexico can verify it. There was no apology, there was no referral to another attorney, nor did he offer to cover any of the additional expenses that would be required to bring a new attorney up to speed on the case. The part of the story that you might find really interesting is that when I was interviewing Allan Gluth to decide whether or not to hire him, it came up that I used to be a racer. He couldn’t wait to tell me that you were one of his clients and he told his opinion of your estate. I will confess that I thought if he was good enough for Holly, he was good enough for me.
